Terms of Service
These terms are an agreement between you and Vaibhav Vashishtha, who operates Panda Speaks (pandaspeaks.com, its subdomains and the blogs hosted on it; "we", "us"). By signing in or using Panda Speaks, you agree to these terms and to our Privacy Policy. If you don't agree, please don't use the service.
The short version: your words are yours, the panda is ours, don't use the platform to harm anyone or infringe anyone's rights, and check what the AI writes before you publish it.
1. Who can use Panda Speaks
You must be at least 18 years old and able to form a binding contract. If you use Panda Speaks for an organisation, you confirm you're authorised to accept these terms for it.
2. Your account
You sign in with a link sent to your email, so keep your email account secure; you're responsible for activity on your Panda Speaks account. One person may hold one account. Tell us at vaibhav777@gmail.com if you think your account has been misused.
3. Your content
You own what you write and upload. We claim no ownership of your posts, images or other content ("your content").
To run the service, you give us a worldwide, non-exclusive, royalty-free licence to host, store, copy, format, display and distribute your content: on your blog and its feeds, in link previews, on the Panda Speaks home page (for example in "recently spoken"), in backups, and to the service providers that power features you choose to use. This licence ends when you delete the content or your account, except for copies in backups (which expire within 14 days) and content others have already shared or cached.
You confirm that you have the rights to everything you publish and that it doesn't infringe anyone's copyright, trademark, privacy or other rights.
4. AI features
Panda Speaks offers AI-assisted writing, dictation and cover images, powered by third-party providers (see the Privacy Policy). When you use them:
- You own the output we generate for you, as far as the law allows. AI output may not be protected by copyright in some countries, and similar output may be generated for other people.
- Check it before you publish. AI can be wrong, invent facts or resemble existing work. You're responsible for what you publish, including AI-assisted content.
- Don't use the AI to create content that breaks section 5, impersonates real people, or copies someone else's work or style in a way that infringes their rights.
- AI features have fair-use limits, and we may change or withdraw them.
5. Acceptable use
You agree not to use Panda Speaks to publish, store or send anything that:
- infringes copyright, trademarks or other intellectual property;
- is unlawful, defamatory, obscene, sexually exploits minors, or promotes violence or terrorism;
- harasses, threatens or incites hatred against any person or group;
- impersonates any person or organisation, or misleads readers about who you are;
- is spam, phishing, malware, or a scam;
- shares someone's private information without their consent; or
- otherwise breaks Indian law, including content prohibited under Rule 3(1)(b) of the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.
You also agree not to probe, overload or disrupt the service, get around its limits or security, scrape it at scale, or use it to train AI models. We may remove content or suspend accounts that break these rules.
6. Copyright complaints
We respect intellectual property and respond to clear notices of infringement under the Indian Copyright Act, 1957, the IT Act, 2000 and, for rights holders elsewhere, laws such as the US Digital Millennium Copyright Act. If you believe content on Panda Speaks infringes your copyright, email vaibhav777@gmail.com with the subject "Copyright notice", including:
- your name and contact details, and whether you are the owner or acting for them;
- a description of the copyrighted work;
- the exact URL(s) of the content you say infringes it;
- a statement that you believe in good faith the use isn't authorised by the owner or the law;
- a statement that the information is accurate; and
- your physical or electronic signature.
We'll review valid notices promptly, may remove or disable access to the content, and will let the blog owner know. If your content was removed and you believe that was a mistake, reply with a counter-notice explaining why; we may restore it unless the complainant takes legal action. We close the accounts of repeat infringers. Knowingly false notices may make you liable for damages.
7. Our intellectual property
Panda Speaks™, the Panda Speaks name and logo, the panda character (its design, artwork, illustrations, animations and expressions), its voice, sounds and spoken lines, the scenes and illustrations on the site, and the software and design of the service are owned by Vaibhav Vashishtha and protected by copyright, trademark and other laws. © 2026 Vaibhav Vashishtha. All rights reserved.
We give you a personal, non-exclusive, non-transferable, revocable permission to use the service as intended. You may not copy, modify, extract, record, redistribute or create derivative works from the panda character, its voice or sounds, or our branding, or use them to suggest an endorsement, without our written permission. Your blog may show the standard "made with Panda Speaks" elements we provide.
If you send us feedback or ideas, we may use them without any obligation to you.
8. Subdomains and custom domains
Your subdomain is provided for as long as you use the service. We may reclaim or change a subdomain that impersonates others, infringes rights or is misleading. If you connect a custom domain, you remain responsible for registering, renewing and configuring it; we aren't responsible for downtime caused by your domain or DNS settings.
9. Changes to the service
Panda Speaks is currently free. We may add, change or remove features, set usage limits, or introduce paid plans. We'll give reasonable notice of changes that significantly affect you, and you'll never be charged without agreeing first.
10. Ending your account
You can stop using Panda Speaks at any time and ask us to delete your account by emailing vaibhav777@gmail.com. We may suspend or close your account, with notice where reasonable, if you breach these terms, if required by law, or to protect the service or others. Sections 3 (for backups), 7 and 11 to 15 continue after your account ends.
11. Disclaimers
We work hard to keep Panda Speaks running and your content safe, but the service is provided "as is" and "as available", without warranties of any kind, to the extent the law allows. We don't guarantee that it will be uninterrupted or error-free, or that AI output will be accurate. Keep your own copies of anything important.
12. Limitation of liability
To the extent the law allows, we aren't liable for indirect, incidental, special or consequential losses, or for lost profits, data or goodwill. Our total liability for any claim relating to the service is limited to the greater of the amount you paid us in the 12 months before the claim and ₹5,000. Nothing in these terms limits liability that cannot be limited by law.
13. Indemnity
If someone brings a claim against us because of your content or your breach of these terms, you agree to cover our reasonable losses and costs arising from it, to the extent the law allows.
14. Governing law and disputes
These terms are governed by the laws of India. Before going to court, please contact us at vaibhav777@gmail.com so we can try to resolve the issue informally. Any dispute that can't be resolved will be subject to the exclusive jurisdiction of the courts at New Delhi, India. If you're a consumer, this doesn't take away any rights you have under the laws of the country where you live.
15. General
We may update these terms; we'll change the date at the top and notify you of significant changes before they apply. Continuing to use Panda Speaks after that means you accept the updated terms. If any part of these terms is unenforceable, the rest still applies. Not enforcing a term isn't a waiver. You may not transfer these terms; we may transfer them to whoever takes over the service.
